Son knocked over friends xbox 360 by accident and scratched disc?

It scratched the disc now it wont work, had the disc repaired by gamestation and still does not work should my son have to pay for a new disc? And how do we get a replacement, its fifa 11.

i have a fifa 09 disk tha has a circle scratch on the edge, another circle in the middle of the disk, and on the other edge how do i fix it??
